Welcome to COINCUBE! These Terms and Conditions ("Terms") govern your use of the COINCUBE Bitcoin wallet software developed by COINCUBE TECHNOLOGY LLC. By downloading, installing, or using COINCUBE wallet software or visiting our website (coincube.io), you agree to be bound by these Terms and our Privacy Policy.

Important: COINCUBE is a self-hosted, non-custodial Bitcoin wallet. This means we do not custody your Bitcoin, hold your private keys, or have the ability to access, freeze, or reverse your transactions. You are solely responsible for the security and backup of your wallet and private keys.

1. Acceptance of Terms

By downloading, installing, or using the COINCUBE | Vault wallet software, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree with these Terms, do not download, install, or use COINCUBE | Vault.

2. Eligibility

You must be at least 18 years old to use COINCUBE | Buy/Sell. By using COINCUBE | Buy/Sell, you represent and warrant that:

• You are at least 18 years of age
• You have the legal capacity to enter into these Terms
• You are not located in a jurisdiction where use of cryptocurrency wallets is prohibited
• Your use of COINCUBE | Buy/Sell does not violate any applicable laws or regulations in your jurisdiction

3. License to Use COINCUBE | Vault Wallet

COINCUBE TECHNOLOGY LLC grants you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to download, install, and use the COINCUBE | Vault wallet software on your personal devices for personal, non-commercial use, subject to these Terms.

4. Self-Hosted, Non-Custodial Wallet

COINCUBE | Vault is a self-hosted Bitcoin wallet, which means:

• You control your Bitcoin: Your private keys and Bitcoin are stored locally on your device, not on our servers
• We cannot access your funds: COINCUBE TECHNOLOGY LLC does not have access to your private keys, seed phrase, or Bitcoin
• We cannot recover lost keys: If you lose your seed phrase or private keys, we cannot recover them or restore access to your Bitcoin
• We cannot reverse transactions: Once a Bitcoin transaction is broadcast, it cannot be reversed by COINCUBE TECHNOLOGY LLC
• You are solely responsible: You bear all responsibility for securing your wallet, backing up your seed phrase, and safeguarding your Bitcoin

5. Your Responsibilities

As a user of COINCUBE, you agree to:

• Secure your seed phrase: Write down and store your 12-word or 24-word seed phrase in a safe, offline location. Never share it with anyone.
• Protect your device: Use strong passwords, enable device encryption, and protect your device from malware and unauthorized access
• Verify downloads: Only download COINCUBE from official sources (coincube.io or official app stores)
• Keep software updated: Regularly update COINCUBE to the latest version for security improvements
• Verify transaction details: Always verify recipient addresses and amounts before confirming Bitcoin transactions

6. Optional Buy/Sell Services

COINCUBE | Vault wallet integrates optional Buy/Sell features provided by third parties, not by COINCUBE TECHNOLOGY LLC. Use of these services is subject to additional terms and conditions.

A. Onramper Integration (Global)

COINCUBE | Vault integrates with Onramper, a third-party service that allows you to buy Bitcoin using various payment methods. When you use Onramper through COINCUBE | Vault:

• You are subject to Onramper's Terms of Service and Privacy Policy
• Onramper will collect KYC/AML information from you as required by their payment partners
• COINCUBE TECHNOLOGY LLC is not responsible for Onramper's services or practices
• Any disputes related to Onramper transactions must be resolved directly with Onramper

B. COINCUBE SOFTWARE COMPANY LTD (Nigeria Only)

For users in Nigeria, COINCUBE | Vault wallet offers a Buy/Sell service operated by COINCUBE SOFTWARE COMPANY LTD, a separate legal entity registered in Nigeria. COINCUBE SOFTWARE COMPANY LTD is not affiliated with or owned by COINCUBE TECHNOLOGY LLC.

When you use COINCUBE SOFTWARE COMPANY LTD's Buy/Sell service in Nigeria:

• You are subject to separate terms and conditions provided by COINCUBE SOFTWARE COMPANY LTD
• COINCUBE SOFTWARE COMPANY LTD will collect KYC/AML information as required by Nigerian law
• COINCUBE TECHNOLOGY LLC is not responsible for COINCUBE SOFTWARE COMPANY LTD's services or practices
• Any disputes related to Nigerian Buy/Sell transactions must be resolved directly with COINCUBE SOFTWARE COMPANY LTD

7. Prohibited Activities

You agree not to:

• Remove, obscure, or alter any copyright, trademark, or other proprietary notices
• Use COINCUBE to transmit malware, viruses, or other harmful code to other users or systems
• Attempt to gain unauthorized access to COINCUBE's infrastructure or systems

8. Intellectual Property and Open Source

COINCUBE | Vault wallet software is based on Liana, an open-source Bitcoin wallet developed by The Liana developers. Both the original Liana wallet and COINCUBE's modifications are licensed under the BSD 3-Clause License.

COINCUBE Branding and Trademarks

While the wallet software is open source, the COINCUBE name, logo, branding, graphics, and other visual elements are proprietary trademarks of COINCUBE TECHNOLOGY LLC. You may not use the COINCUBE trademarks without our prior written permission, except as necessary to accurately describe your use of the COINCUBE | Vault wallet software.

We acknowledge and thank The Liana developers for creating the original Liana wallet software upon which COINCUBE | Vault is based. For more information about Liana, visit wizardsardine.com/liana.

9. Disclaimers

COINCUBE | VAULT WALLET SOFTWARE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND. To the maximum extent permitted by law, COINCUBE TECHNOLOGY LLC disclaims all warranties, express or implied, including but not limited to:

• Warranties of merchantability, fitness for a particular purpose, and non-infringement
• Warranties that COINCUBE | Vault will be uninterrupted, error-free, or secure
• Warranties regarding the accuracy or reliability of any information provided

Bitcoin risks: You acknowledge that Bitcoin transactions carry inherent risks, including but not limited to:

• Price volatility and potential loss of value
• Irreversible transactions that cannot be undone
• Risk of sending Bitcoin to incorrect addresses
• Network congestion and transaction delays
• Regulatory uncertainty and potential legal changes

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, COINCUBE TECHNOLOGY LLC AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR:

• Loss of Bitcoin or other funds due to lost private keys, seed phrases, or forgotten passwords
• Unauthorized access to your wallet due to device compromise or user error
• Incorrect transactions, including sending Bitcoin to wrong addresses
• Bitcoin price volatility or market losses
• Service interruptions, bugs, or software errors
• Any indirect, incidental, special, consequential, or punitive damages arising from your use of COINCUBE | Vault or any other COINCUBE products or services

Our total liability to you for any claim arising from these Terms or your use of COINCUBE shall not exceed $100 USD.

11. Indemnification

You agree to indemnify, defend, and hold harmless COINCUBE TECHNOLOGY LLC and its officers, directors, employees, and agents from any claims, liabilities, damages, losses, or expenses (including legal fees) arising from:

• Your use or misuse of COINCUBE
• Your violation of these Terms
• Your violation of any applicable laws or regulations
• Your violation of any third-party rights

12. Updates and Changes to COINCUBE

We may release updates, new features, or bug fixes for COINCUBE from time to time. You acknowledge that:

• Updates may be required for security or functionality reasons
• Some updates may change features or require you to accept new terms
• We may discontinue support for older versions of COINCUBE | Vault
• We may discontinue COINCUBE | Vault entirely with reasonable notice

13. Changes to These Terms

We may modify these Terms from time to time. We will notify users of material changes through our website or within the COINCUBE | Vault app. Your continued use of COINCUBE | Vault after changes become effective constitutes your acceptance of the revised Terms. If you do not agree to the revised Terms, you must stop using COINCUBE | Vault.

14. Termination

These Terms remain in effect until terminated. You may stop using COINCUBE | Vault at any time by uninstalling the software from your device. We may terminate or suspend your access to our website or optional services if you violate these Terms, though we cannot prevent you from continuing to use the self-hosted wallet software if already installed.

Important: Because COINCUBE | Vault is self-hosted, termination of these Terms does not affect your access to Bitcoin stored in your wallet or your ability to use the wallet software already installed on your device.

15. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of Wyoming, United States, without regard to conflict of law principles. Any disputes arising from these Terms or your use of COINCUBE | Vault shall be resolved through:

• Good faith negotiation between the parties
• Binding arbitration if negotiation fails
• In the courts of Wyoming, United States if arbitration is not available

16. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

17. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and COINCUBE TECHNOLOGY LLC regarding your use of COINCUBE | Vault and supersede all prior agreements and understandings.
